1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Model Pipeline AI Inc., a Delaware corporation operating the ImagePipeline platform ("ImagePipeline", "we", "us", or "our"), governing your access to and use of our AI image generation services, APIs, and related services (collectively, the "Services").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease all use of our Services.

We may modify these Terms at any time. Updated versions will be posted with a revised effective date. Continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility and Account Requirements

You must be at least 13 years old to use our Services. Users aged 13–18 must have parental or guardian consent. By using our Services, you represent and warrant that:

  • You have the legal capacity to enter into this agreement
  • All registration information you provide is accurate and current
  • You will maintain the security of your account credentials
  • You are not prohibited from using our Services under applicable laws
  • You will comply with all applicable laws and regulations

One account per user. Sharing, selling, or transferring accounts is strictly prohibited. You may not access the Services if you are located in a country subject to United States export restrictions or sanctions.

3. User Responsibilities and Content

3.1 Your Responsibility for Generated Content

You are solely and exclusively responsible for all content you create, generate, upload, or distribute using our Services ("User Content"), including all images, prompts, and materials you input or generate; any use, distribution, or publication of generated outputs; ensuring your content complies with all applicable laws; and obtaining all necessary rights and permissions for any third-party materials.

You acknowledge that AI-generated outputs may not be unique and may resemble outputs generated for other users.

3.2 Prohibited Activities

You agree not to use our Services to create, generate, or distribute content that:

  • Violates any applicable law or regulation
  • Infringes intellectual property, privacy, or publicity rights
  • Constitutes or depicts child sexual abuse material (CSAM)
  • Depicts non-consensual sexual acts or deepfakes of real individuals without consent
  • Promotes violence, terrorism, hate speech, harassment, or discrimination
  • Contains malicious code or harmful technology
  • Impersonates any person or entity in a misleading manner
  • Is fraudulent, deceptive, or materially misleading
  • Violates any third-party terms or policies

3.3 Depictions of Real Individuals

You agree not to use the Services to generate content that falsely represents, impersonates, or misleads others into believing that an identifiable individual has said, done, or endorsed something they have not. You are solely responsible for obtaining all necessary permissions, releases, and legal rights to use the likeness, voice, identity, or persona of any identifiable person. ImagePipeline does not verify the identity or consent of individuals depicted in user-generated content and accepts no liability for such content.

3.4 Monitoring and Enforcement

While we are not obligated to monitor User Content, we reserve the right to review content for safety and compliance, use automated detection systems, remove or restrict access to content, and suspend or terminate accounts. We may cooperate with law enforcement where required by law and may preserve relevant account data and usage logs in response to valid legal process.

4. Service Availability

The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, accuracy or reliability of generated content, or continuous availability of any specific model or feature. We may modify, suspend, or discontinue any part of the Services at any time without notice. Prohibited actions include reverse engineering, automated scraping, circumventing security measures, and abusing API rate limits.

5. Intellectual Property

5.1 Ownership of Generated Content

Paid subscribers own the images they generate through our Services, subject to compliance with these Terms.

Free tier users receive a licence to generated images under Creative Commons Attribution-NonCommercial 4.0.

Enterprise users — organisations with annual revenue exceeding $1,000,000 USD — may require an Enterprise plan for commercial use at scale.

Ownership applies only to generated outputs and does not grant rights to the underlying AI models, training data, or platform technology. We do not guarantee that generated content is eligible for copyright protection under applicable law.

5.2 Generated Content Storage

Generated images and prompts are stored temporarily to allow users to retrieve results. Generated media and prompts are automatically deleted from our systems within 30 days of creation. ImagePipeline does not use your content to train AI models unless explicitly agreed for enterprise services.

5.3 Our Intellectual Property

All rights, title, and interest in our Services, platform, and underlying technology remain the property of Model Pipeline AI Inc. Nothing in these Terms transfers any ownership of our intellectual property to you.

5.4 AI Output Characteristics

You acknowledge that AI systems may produce outputs that are similar or identical to content generated for other users. ImagePipeline makes no representation that generated outputs will be unique, exclusive, or free from similarity to third-party content. You are solely responsible for reviewing outputs and ensuring your use complies with applicable laws and third-party rights.

6. Indemnification

You agree to indemnify, defend, and hold harmless ImagePipeline and Model Pipeline AI Inc., its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to your use of the Services, your User Content, your violation of these Terms, or your infringement of any third-party rights.

7. Payment and Refunds

Subscription fees are billed in advance. Refunds are available within 24 hours of purchase only. After 24 hours, all purchases and subscriptions are non-refundable. We reserve the right to modify pricing with reasonable notice to subscribers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ImagePipeline's total liability to you for any claims arising under or related to these Terms shall not exceed the greater of (a) $100 USD or (b) the total amount you paid to us in the 12 months preceding the claim. In no event shall ImagePipeline be liable for indirect, incidental, special, consequential, or punitive damages.

9. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms, engage in abusive or fraudulent activity, or for any other reason at our discretion. Upon termination, your right to use the Services immediately ceases.

10. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.

11. General

These Terms constitute the entire agreement between you and ImagePipeline with respect to the Services. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision shall not constitute a waiver.
